Trump Considering 'State Secrets' in Deportation Case: Official

Deputy Attorney General Todd Blanche revealed in a recent court filing that there are ongoing discussions at the Cabinet level about potentially invoking state secrets privileges in response to a judge’s request for more details regarding the deportation of Venezuelans.

Judge James Boasberg had instructed the Trump administration to clarify its rationale for invoking the 1789 Alien Enemies Act, a law historically used only during wartime. Trump has asserted that the Venezuelan Tren de Aragua gang has "invaded" the U.S. through undocumented migration. Although Boasberg has prohibited the administration from using the law for further deportations, over 200 Venezuelans were already en route to El Salvador when the order was issued.

The state secrets privilege allows the executive branch to withhold specific information in legal proceedings if it poses a risk to national security.
